Minute Corrections

      06/08/06 minutes correction:

          - "Rick drafted shed petition w/ minor corrections."          

     06/29/06 minutes corrections:

          - Addition to end of 'Steve Blanchies' first bullet, "or $100 minimum."

           - Under 'Sheds', "Shed size 12 x 16 proposal approved."

(Arrival of President of Chadwyck community)

Chadwyck/CMS - (Chadwyck is contracted w/ CMS.  President of Chadwyck came to provide reference information for CMS).          

     This is Chadwyck's first full year working w/ CMS.          

      Pres. has seen improvement in collection of delinquent accts.          

     Cost to community: $8700 (first year), $2000 (second year).          

     Chadwyck has 283 homes w/ assessments of $180/year.          

     The board notified delinquent Chadwyck residents that Steve Blanchies would be assigned to collecting funds after a certified letter of delinquency was sent.          

     Steve has been willing to do payment plans for families under financial hardship.          

     CMS procedures: Go to homes of delinquent residents and request payment.  If payment not received, a certified letter is sent.          

     Chadwyck residents have taken CMS more seriously than when board pursued collecting delinquent accounts.          

     CMS involvement begins after county letter is sent and the due date (30 days from date county letter is sent) is exceeded.

Chadwyck Side Item          

     Pres. of Chadwyck stated that Atkins is not a good contractor.

Vote on Contracting w/ CMS          

     5 yes votes, 1 no vote.          

     Contract agreement is contingent upon CMS' acceptance of contract amendments and additions as agreed upon by the board (See 'Amendments/Additions to CMS Contract').

CMS Procedures          

     Rick had a question on what steps are taken by CMS for collections. 

     The answer was expressed as:

          1.   Door-to-door payment request.

          2.   Certified letter mailed if payment not received.

         3.   JP court filing for lien on homes of remaining delinquent homeowners.

Amendments/Additions to CMS Contract          

     Change Section IV 'Effect of Agreement' to state, "Respective parties and successors may terminate this agreement at any time at their will."          

     In Section I under 'Delinquent Assessment Collection' paragraph one sentence three, remove the wording, "In most cases."          

     In Section I under 'Delinquent Assessment Collection' at the end of paragraph one add, "WMC will pay CMS a maximum of $125.00 for filing liens against delinquent homeowners.  CMS will reimburse WMC for these lien costs upon receiving payment from the delinquent homeowners.  CMS will provide WMC copies of all lien paperwork via certified mail within 3 business days of filing."          

     Trish will draft amendments/changes as agreed upon by the board and forward them to Rick.           

     Rick will review draft, forward the draft to Steve and request an updated contract.          

     Rick will bring two copies of the updated contract to sign at the July 27th community meeting.
